NYSDEC has approved the use of Bell Labs RAT ICE for use by 7A,7B,3A & 3B Certified Applicators, Technicians and apprentices pursuant to an Enforcement Discretion Letter dated August 21, 2017.

This is a departure from the original opinion approximately a month and half ago which would have restricted the use of the material to 7B Fumigation certified applicators. The original decision was based on what many believe to be an antiquated NYSDEC definition of fumigants which was made back when your first fumigation mistake was your last due to the high toxicity and mode of action of the materials used at that time. From the outset of registration NYPMA, director of Public Affairs, Gil Bloom has been in contact with DEC and has been contributing scientific data, enlisting letters of opinion from various NY State stakeholders, through NPMA assistance procuring input from EPA as well as political input by some non-traditional contacts.

The NYPMA Board and membership applaud this decision by NYSDEC and are encouraged by its vision in providing for the use of this product to assist in the battle against this public health pest.  We would also like to acknowledge Bobby Corrigan PhD for his strong advocacy in regard to the use of dry ice for rats. With this decision Bell Labs will be finalizing distribution logistics and we look forward to seeing the product in use.
